You agree to adhere to all applicable laws, regulations, and codes of conduct when using the EPC Choice Ltd website.

You agree not to:

• Damage, interfere, or disrupt the website or access to the website;
• Gain or attempt to gain unauthorised access by any means to any restricted EPC Choice Ltd computer networks or systems;
• Make available, upload, or distribute on the EPC Choice Ltd website any materials or files that contain viruses or any other harmful software;
• Use the website to send unsolicited material for any purpose.

Although EPC Choice Ltd endeavours to ensure the contents of this website is correct it shall not be liable for any damages arising in contract, tort, or otherwise from the use of or inability to use this site, or any material contained within it, or from any action or decision taken as a result of using this site or any such material.

Please note that any links to external websites are provided for information and convenience only. EPC Choice Ltd does not accept responsibility for the sites linked to, or the information found there. A link does not imply an endorsement of a site; likewise, not linking to a particular site does not imply lack of endorsement.

We reserve the right to withdraw a link or refuse to link to any website without providing an explanation or justification.

Payment Terms and Conditions

1. Payment

1.1 Services must be paid for in advance, whether using online credit card processing facilities, paying via telephone with a credit/debit card, direct bank transfer or cleared Cheque. In the event that we provide you with a credit facility, our payment terms will be clearly stated on the invoice.

2. Your Obligations

2.1 You agree to ensure that the information that you supply to us in the Order including without limitation details of the Property is complete, accurate and up to date. You will notify us immediately you become aware of any inaccuracy contained within the Order.

2.2 You agree that any order that we may deliver to you is delivered on the understanding that it is only for your use and for the purpose that you have disclosed to us.

2.3 Pre-arranged appointments with the fieldworker are taken on the understanding that an Adult will be present to provide access to the property at the appointment time. If the fieldworker is unable to obtain access to the premises within 15 minutes of their arrival at the property, then a service charge of £25 will payable for the missed appointment. This may also result a delay in the production time of your Order and/or affect your right to cancel.

2.4 In the case of an Energy Performance Certificate. You agree to have any insulation certificates, at the time of inspection, available to the assessor. Any instance where the certificates are not available may result in insulation being recorded as’not present’ or ‘unknown’.

2.5 You agree that if you note an error within the certificate either with the rating, recommendation or address you will highlight this within 1 month of instruction of the service. After this date we are unable to make amendments.

2.6 You agree that the service rendered commences immediately upon purchase or the placing of an order via our website. This includes the necessary administration and is not restricted to the site visit or production of documentation or any certificate.

2.7 You agree that the service and turnaround time described is not a guarantee and accept that adherence to this may not be possible in all instances. You agree to notify us as soon as is reasonably practicable if you have not received the described service. You will not be entitled to a refund of the full service fee if you cancel your order in relation to service or turnaround time not being as described, although a partial refund may be issued at the discretion of senior management (see section 5. Cancellation).

2.8 You agree that it is your responsibility to ensure that the service ordered is both necessary and the correct service for your individual requirements. You will not be entitled to a refund of the full service fee if you cancel your order due to their being an existing EPC for the property or because the service ordered was subsequently unsuitable or no longer required for any reason, regardless of whether or not an Assessor has visited the your property.

3. Liability

3.1 We cannot accept any liability for any error in a report which is based on any error or inaccuracy in a public register. Nor will we be liable for any information contained within a report which is based on information that we have obtained from a third party (not being information derived from the public register).

3.2 We cannot accept any responsibility for any inaccuracy or error in the report that is based on incomplete or inaccurate information supplied by you.

3.3 Subject to any other provisions in these Conditions, we will not be liable to you for any loss,damages, costs or expenses caused directly or indirectly by a delay in delivery to you (even if caused by our negligence).

3.4 We will not be liable for any loss of actual or anticipated profits or savings, loss of business, loss of opportunity or for any special, indirect or consequential loss whether arising from a breach of these Conditions or negligence in performing the Services even if we were advised of or knew of likelihood of such loss occurring.

3.5 Our entire aggregate liability to you for direct loss arising from our being in breach of these Conditions or negligent in the course of performing the Services will not exceed the cost of the Service.

3.6 If ordering an EPC, by placing an order you are confirming that you require us to complete an EPC and replace any in date and active EPCs that may exist, even if no changes have been made to the property.

4. Pricing & Confirmation of Orders

4.1 All prices are stated on our Website and are subject to VAT where applicable.

4.2 Upon submission of any order via our Website, you are confirming that you have accepted our Terms and Conditions and the price as stated. If you have not agreed to the price as stated, you should advise us immediately to avoid any cancellation charges as specified in Section 5. Cancellation.

4.3 The Website prices quoted are for properties anywhere on the Mainland of England and Wales.

4.4 Payment is due from you on submission of your order for the service of our fieldworkers and if we do not receive payment from you on order, we reserve the right to cancel your order and terminate our services forthwith.

4.5 If you require a copy of your report sent by post then a £5 charge will apply.

4.6 The method of payment and or any credit facility will be as agreed between us.

4.7 Following receipt of payment, the allocated fieldworker will confirm acceptance of the booking to the Client via telephone to the contact number provided.

4.8 If your Instruction is made under false pretence an additional fee may be due and the report will not be issued until we receive receipt of said additional fee.

4.8 You are aware that the services are to be provided to you by a third party.

4.10 The Website prices quoted are for properties anywhere on the Mainland of England and Wales. The fee shown on our Website is for residential EPC’s is fixed for buildings up to 4 bedrooms which are less than 150 m2. For larger buildings, a quote must be obtained prior to booking.

4.11 The Website process shown for EICRs is based on the property having the same amount of fuse boards as selected on the order form. If there are additional fuse boards on site then these will be charged at an additional £100 per board. The price covers a maximum of 10 circuits per fuse board, additional circuits are £20 each.

4.12 The Website process shown for Gas Safety Certificates and/or Boiler services is based on the property having a maximum of two gas appliances. If there are additional gas appliances on site then these will be charged at £35 per appliance.

5. Cancellation

5.1 Should you wish to cancel or re-schedule an Order, you agree to give us as much notice as is reasonably practicable. However, you will not be entitled to obtain a full refund of the Service Fee if you cancel on or after the Confirmation of order. A partial refund may be issued at the managers discretion but any refund will be subject to a Service Charge. The charge levied is based on individual circumstances and the level of service provided, and can be up to 30% of the total order value (inclusive of VAT).

5.2 We reserve the right to cancel any instruction after confirmation of order and will contact the client directly to discuss this as quickly as possible. This does not usually encounter a service charge and a full refund can be issued.

6. Floorplans

6.1 The plans are provided are basic floorplans of limited detail for illustrative purposes only. They will not be to scale or land registry compliant.

6.2 The floorplans will be as accurate as the software will allow. The basic floorplan is not required to include exact measurements. These can be added at your request however it is your responsibility to provide us with the accurate information.

6.3 Floorplans will provide the size and layout of the building and any permanent structures true to the time of the assessment.

6.4 If a floorplan needs to be amended then a copy of the plans showing the amendments will need to be emailed into the office the alterations will then be made accordingly.

6.5 It may not be possible to obtain a full refund for a completed floorplan (see section 5. Cancellation).

7. Commercial EPC’s

7.1 All Commercial EPC’s are priced based on the size of the total usable floor area of the property.

7.2 All the quotations are subject to the provision of suitable information and are subject to change should we incur additional costs for which EPC Choice Ltd are not liable. It is the responsibility of the person placing the order to provide complete, accurate and up to date information.

7.3 If you are unable to provide us with the correct size of the property then you accept that our quote is an estimate. If you choose to proceed and place the order then you accept that a surcharge will be payable should the total usable floor area be greater than our original estimate at the time of booking.

7.4 If you refuse to pay the surcharge then we will not provide you with the EPC and your right to cancel the order may be affected. The charge is levied to cover the additional costs involved in surveying a larger property, all prices for properties up to 1000m2 are available at the time of the order and are clearly displayed on the website.

8. Coverage

8.1 Whilst we endeavour to provide full national coverage there may be some exceptions, which will be dealt with on a case by case basis. If we are not able to cover your required area at the time of booking, a member of staff will contact you as quickly as possible to discuss alternative options. In some circumstances, we may be able to complete the instruction after agreeing a rural surcharge fee with the client but this will be dealt with on an ad-hoc basis.
